Information on permission to work under the amended Immigration Control

The Korean Immigration Control Act has been revised and the amended Act will come into force on 20 June 2009. The amended Act includes new provisions on work.

Humanitarian Status Holders
The amended Act includes provision for the Minister of Justice to allow persons who have humanitarian status in Korea to work. If you have humanitarian status you may wish to go to your local immigration office to apply for a work permit from 22 June 2009. See below: Details about the Work Permit Application.

Refugee Status Applicants
The amended Act also includes provision for the Minister of Justice to allow persons who have made an application for refugee status in Korea to work. It appears that this provision will not be applicable until one year after 20 June 2009, so it will not be effective until approximately 20 June 2010.

The provision will also only apply to refugee status applicants who have been waiting for a decision on their claim for at least one year. This means they can apply, after 20 June 2010, to be allowed to work when it is one year after the date they made their refugee application.

Under the Act, however, the Minister of Justice may allow refugee status applicants to work under special circumstances. It is not clear from the Act what the special circumstances are, but this means that in some cases a refugee status applicant may be allowed to work, even if it is not one year from the date they made their refugee application. This provision will also be effective from 20 June 2009.

Details about the Work Permit Application
You will need to provide the following documents to the immigration office:

• Passport and Alien Registration Card
• Completed Application Form
• Employment contract + other documents depending on the contract
• Application fee (the amount of the fee will depend on the employment contract)


On Monday 22 June 2009 there will be a person helping people make their work permit applications throughout the day at the Seoul Immigration Office in Mokdong.
